Before you start
- Accurate tenancy and property facts in Fructus, for example whether a deposit was taken.
- Your own record of why a requirement does not apply, such as the tenancy agreement or professional advice.
Recognise a not-applicable requirement
Find the requirement on the Tenancy tab
A requirement marked not applicable is shown as such rather than as overdue. For example, a deposit-related requirement can be marked not applicable for a tenancy where no deposit was recorded.
Open it to see the context
Review the tenancy and property details shown with the requirement.
Review the facts behind it
Not applicable depends on what has been recorded. If a recorded fact is wrong, the outcome may be wrong too.
Check the recorded tenancy and property facts
Confirm the facts the requirement depends on, such as deposit details, match your documents. Correct them on the tenancy or property record if they do not.
Keep your own reasoning
Keep a factual rationale and supporting documents, such as the tenancy agreement or advice received. If your current requirement view provides a decision or reason control, record the decision and rationale there, review the entry and reopen the requirement to check the result. If no such control is available, keep the reasoning in your organisation’s records; do not mark the requirement completed as a substitute for not applicable.
Review again when circumstances change
A change such as taking a deposit part-way through, or a new tenancy, can make a requirement relevant again. Recheck after any change.
Frequently asked questions
Why is a requirement not applicable for one tenancy and required for another?
Applicability depends on the recorded facts of each tenancy, such as whether a deposit was taken. Two tenancies in the same building can differ.
Can I mark a requirement not applicable myself?
This guide does not describe a control for doing so. The status reflects recorded facts. If a requirement looks wrong, check the underlying tenancy and property facts or seek advice.
Does Fructus decide what applies to my property?
No. Fructus organises records. Whether an obligation applies is a matter for you and your advisers.
Does Fructus confirm that my property is legally compliant?
No. Fructus helps you organise compliance records, monitor deadlines and manage supporting evidence. Compliance information reflects the records and dates entered into your workspace and does not constitute an independent legal assessment or certification. Requirements vary depending on the property and circumstances, so seek professional advice where appropriate.
